When a house is up for sale the seller must disclose all defects to the property that can be found upon reasonable inspection of the property to the buyer.Faults the seller is unaware of ,perhaps a leaky roof, will be covered by the ‘voetstoots’ clause which is also known as “buyer beware”, meaning the property is sold as is including all it’s faults.However if the seller does indeed know of a fault and does not disclose the information to the buyer he has then defrauded the buyer and will then still be liable for the fault.
