President of the ANC,Jacob Zuma, is open for prosecution on corruption charges again.The Bloemfontein supreme court of appeals has announced that Judge Chris Nicholson overstepped his authority in his decision to stop charges against Jacob Zuma.
According to the appeal court he should not have introduced or debated the question of political and presidential interference when considering the charges against Mr Zuma.
The court also announced that Mr Zuma’s right to make a representations before the NDPP decided to charge him was not applicable.
Judge Nicholson’s decision had far reaching consequences and in the midst of that scandal former President Thabo Mbeki was ousted and current President Kgalema Motlanthe was announced to take over until the next general election.
Nicholson will not face any repercussions as a judge makes a decision to the best of his abilities with the information available to him.
Many people consider having a President or presidential candidate that has serious legal charges against him greatly detrimental to South Africa’s future and image and detrimental to the ANC’s image.
We will have to wait and see if Jacob Zuma appeals this decision and then whether or not he is again prosecuted on the corruption charges still following him around.
